This course offers a rigorous training in Human Rights (HR) and International Humanitarian Law (IHL) applied to the legal analysis of the Colombian armed conflict, from a normative, jurisprudential, and institutional perspective as seen through Public International Law. Throughout the course, students will explore the conceptual and legal foundations of HR and IHL, their scope of application, and their complementary nature in contexts of non-international armed conflict.
The course analyzes the principles of IHL, the protected subjects, and the obligations of the Colombian state according to international and constitutional law. It delves into the jurisprudence of the Inter-American Human Rights System, addressing the state’s international responsibility, the duty to prevent, investigate, punish, and repair harm, as well as the control of conventionality. A special analysis is dedicated to the extermination of the Unión Patriótica, examining the actions of the Inter-American Commission on Human Rights and the applicable international standards.
Moreover, the course studies the internal regulatory framework, particularly Law 1448 of 2011 (Victims and Land Restitution Law), the rights of victims of the armed conflict, and the transitional justice mechanisms, including the Special Jurisdiction for Peace (JEP) and the Integral System of Truth, Justice, Repair, and Non-Repetition. This course does not cover the history of the armed conflict from a chronological perspective but focuses on its legal analysis, allowing students to develop a critical understanding of the Colombian conflict through the standards of HR and IHL.
